Terms of Services (TOS)

1. Purpose of the Service
The application provides racket clubs with a management platform that includes:
– court management
– team member and role management
– online payments for player reservations via the app or through an embeddable web link for the club’s website
– a dashboard showing the club’s revenue and reservations

2. Acceptance of the Terms
Using the service implies full and unconditional acceptance of these Terms of Service.
If you do not agree with these terms, you must stop using the application.

3. Account Creation
Users must provide accurate information when creating an account.
Any account created on behalf of a club must be authorized by the club.
The provider reserves the right to suspend or delete any account in case of inaccurate information, abusive use, or non-payment.

4. Access to the Service
Access is provided to the best extent possible, but may be interrupted due to:
– maintenance
– updates
– technical incidents
The provider does not guarantee permanent availability but commits to informing clubs about major issues and providing at least 7 days’ notice for scheduled maintenance.

5. Subscriptions and Payments
Payments are handled by Paddle (Merchant of Record).
Pricing is displayed on smashup.ch/pricing and during the club onboarding process within the application.
Subscriptions renew automatically unless cancelled before the renewal date.

6. User Obligations
Clubs and users agree to:
– use the platform legally and appropriately within the scope of their activity
– not attempt to access data belonging to other users
– not circumvent security measures
– not use the platform to process illegal or sensitive data without authorization
The club is responsible for the actions of its staff members who have access to the application.

7. Data and Privacy
Data processing is governed by the Privacy Policy.
The provider acts as a data processor for the club’s member data (GDPR — Art. 28).
The club remains responsible for the legality, accuracy, and compliance of the data it enters into the platform.

8. Intellectual Property
All content, code, features, graphical elements, and the overall structure of the service are the exclusive property of the provider.
No reproduction, modification, or distribution rights are granted without prior written authorization.

9. Limitation of Liability
The service is provided “as is”.
The provider is not liable for:
– financial losses resulting from improper use
– errors caused by the user or their staff
– interruptions caused by third parties (hosting, Paddle, external APIs)
– booking errors or disputes between players/members
The club remains solely responsible for its activity, its internal organization, and the management of its reservations.

10. Termination
Users may cancel their subscription at any time via their Paddle account.
Cancellation takes effect at the end of the current billing period.
The provider may terminate an account in cases of fraud, non-payment, or serious violation of these Terms.

11. Changes to the Service or Terms
The provider may modify the features or these Terms at any time.
Users will be notified in case of significant changes.

12. Governing Law and Jurisdiction
These Terms are governed by Swiss law, subject to mandatory applicable rules in the user’s country.
Any dispute shall be brought before the competent courts of the provider’s registered office.
